Know The Law

According to California workers’ compensation laws, it is mandatory for employers to provide workman's comp to all of its employees. Workers’ comp benefits ensure that all employees receive medical care and other benefits they need if they have a work-related injury or illness.

No-Fault System

In California, workers' compensation insurance is a no-fault system. When medical attention is needed in the workplace the employer has to comply with the no-fault policy and the employee is entitled to compensation for any damages, regardless of how and why the injury happened.

A right to report

Within 30 days, it is an employee’s right to report workplace injuries. After, the employer is then required to file a claim. If the employer fails to submit a claim promptly, an employee can submit a worker’s compensation claim. If your employer feels that you stepped beyond your rights in doing so, the law offices of Bo Katzakian can help. According to the Labor Code 132(a), firing a worker for filing their own claim may enable them to seek legal counsel if they can prove the two incidents were related.

Along with serious injuries that happen at the workplace, injuries and illnesses that can be grounds for a worker's comp claim may also include:

Diseases that result from dangerous conditions in the workplace, such as illnesses that were caused by exposure to harmful chemicals.

A cumulative physical injury from repetitive stress and strain that developed over time from carrying out the same daily tasks.

WHAT WORKERS COMPENSATION DOESN’T COVER

Workman’s comp will rarely cover injury or illness caused by a worker’s poor choices.

Injuries as a result of misconduct that will not be covered in a workers’ compensation claim include:
  • Self-inflicted injuries/illness
  • Physical confrontations
  • Injuries while not on the job
  • Injuries while intoxicated
  • Injuries caused by violating company policies
If business policies were being violated or there was evidence of horseplay, it may be enough for a claim denial. Now, if employers permit certain behavior or if roughhousing behavior is a common occurrence in the workplace, it could potentially be seen as a work-related injury. It is always the right idea to enlist the assistance of an experienced workers’ comp attorney.

Eligible for Workers’ Comp Benefits?

If you were injured or suffered illness as a result of your work, you could be entitled to filing a workers’ compensation insurance claim. Compensation can include payments for medical bills, lost wages, and even rehabilitation programs. Most times, in exchange for workman’s comp protection, you forfeit your right to file a lawsuit against your employer for any injuries, damages, or illnesses they caused (except in a few situations when you can sue outside the workman's comp system).
